The Department of Water and Sanitation has gazetted the Draft Water and Sanitation Service on Privately Owned Land; through the government gazette notice No: 47558;689
As a sector leader, the Department of Water and Sanitation is embarking on a comprehensive stakeholder consultation for the Draft Water and Sanitation Sevices Policy on Privately Owned Land for 60 days. The Draft Policy is a culmination of the 2017 Mshengu vs uMsunduzi LM, uMshwathi LM, uMgungundlovu DM and others, in which the judge indicated that the failure by the implicated municipalities to provide farm occupiers and labour tenants who are living in their areas of jurisdiction with access to basic sanitation, sufficient water and collection of refuse is inconsistent with the Constitution of the Republic of South Africa particularly Section 9, 10, 24, 27(1)(b), 33, 152, 153, 195 and 237.
The draft Water and Sanitation Services Policy on Privately Owned Land expands and operationalizes chapter V(5) of the Water Services Act (Act No. 108 of 1997), in which the Department seeks to use the private land owners as intermediaries in the provision of the water and sanitation services.
